Terms of Use

These Terms of Use ("Terms") govern your use of the Wakey Jakey app and related services ("the Service"), provided by By Better Human ("we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Wakey Jakey is an iOS alarm app that wakes you with a personalized AI-generated voice briefing. The Service requires iOS 26 or later and an internet connection to generate briefings (the alarm itself plays a previously generated, on-device briefing and is designed to work offline).

2. Your account

You sign in with your email address. You are responsible for keeping access to your email secure and for activity under your account. You must be at least 13 years old to use the Service.

3. Subscriptions, free trial, and billing

• Wakey Jakey is offered as an auto-renewing subscription with an introductory free trial. Pricing is shown in the app before you purchase.
• Payment is charged to your Apple ID at confirmation of purchase. After any free trial, the subscription automatically renews at the stated price unless you cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription, and turn off auto-renewal, in your device's Settings → Apple ID → Subscriptions at any time.
• Subscriptions are billed and managed by Apple through the App Store. Refunds are handled by Apple in accordance with the App Store terms; we generally cannot issue refunds directly.

4. Acceptable use

You agree not to misuse the Service — including attempting to access it through means other than the app we provide, reverse-engineering it, reselling it, or using it to violate any law or another person's rights.

5. Your content and data

You control which data sources (calendar, reminders, location, goal) you enable. How we handle that data is described in our Privacy Policy, which is part of these Terms.

6. The Jakey voice and our intellectual property

"Jakey" and the Jakey voice are original, owned synthetic creations. The app, its content, and its branding are owned by us or our licensors and are protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the Service for your own use.

7. Alarms — important

Wakey Jakey is built for reliability, but no software alarm can be guaranteed to fire in every circumstance (for example, a powered-off device, a depleted battery, or an operating-system change). Do not rely on Wakey Jakey as your sole means of waking for safety-critical situations. The Service is provided "as is."

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Service is provided without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages, or for any missed alarm, missed event, or lost data. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate access if you violate these Terms.

10. Changes to these Terms

We may update these Terms; we will revise the effective date above and, where appropriate, notify you in the app. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the United States and the state in which the provider is established, without regard to conflict-of-laws rules.
